Best of Bangladesh Terms and Conditions

These Best of Bangladesh Terms and Conditions (the “Terms”) apply to your (“you” or “your”) attendance of, or participation in Best of Bangladesh’s (“Best of Bangladesh,” “we” or “us”) Best of Bangladesh (“event”). If you do not accept these terms and conditions, you may not be able to attend or participate in the event.

1. Rules of Conduct; Remedial Actions.

It is mandatory for you to follow our Code of Conduct in order to attend the event in person or virtually. By registering for this event, you confirm that you have carefully read, understood, and agreed to follow the Code of Conduct. Additionally, you acknowledge and agree to accept the consequences of failing to comply with the Code of Conduct.

2. COVID Protocols

By accepting the terms, you are explicitly acknowledging and agreeing to the following “COVID PROTOCOLS”:

You will not attend the event in person if:

  • You have not been fully vaccinated against COVID-19;
  • You have been diagnosed with COVID-19 within ten (10) days of the event;
  • You have experienced any symptoms associated with COVID-19 within ten (10) days of the event;
  • You believe you have been exposed to an individual with COVID-19 within ten (10) days of the event and have not received a negative COVID-19 test

In addition,

  • If you are fully vaccinated, you need to provide proof of your vaccination status approved or authorized for emergency use by the European Commission or a similarly situated body in your country of residence to Best of Bangladesh, which can be in the form of a vaccination card or a copy or photograph thereof. 
  • All event attendees, including but not limited to attendees, Best of Bangladesh team members, and sponsors, must be fully vaccinated to attend the event and agree to provide proof of vaccination status to Best of Bangladesh at any time during the event.
  • Best of Bangladesh reserves the right to modify the COVID Protocols.
  • You agree to check the COVID-19 Safety Acknowledgement regularly to remain updated on any changes and comply with them.

3. Security

  • Best of Bangladesh reserves the right to take any security measures it deems necessary for the safety of attendees and participants of the event, without prior notice. You are required to comply with all security measures, including the following:
  • During the event, bags may be randomly checked.
  • You cannot leave any bags or other property unattended at any time. If you notice any unattended property, you should report it to Best of Bangladesh, and it may be removed.
  • Firearms and other weapons, explosives, illegal drugs, and other hazardous or illegal materials or articles are all prohibited. You will not bring any such prohibited items with you or have them in your possession at any time during your in-person attendance of the event.

4. Publicity Release

  • During the event, Best of Bangladesh or others on its behalf may take photographs, record audio or video, webcast, podcast, or otherwise transmit any or all parts of the event, including during event sessions, breakouts, keynotes, or other activities. Your image, likeness, voice, statements, and other identifying characteristics may be captured in these photographs, recordings, webcasts, podcasts, or other event transmissions, which are referred to as “Recordings.”
  • By attending the event, you grant Best of Bangladesh a worldwide, non-exclusive, transferable, fully sublicensable, perpetual, irrevocable, royalty-free, and fully paid-up license to use and exploit any Recordings of the event (including your Images therein) in any format or media, for any purpose, without additional consideration to you or any third party. This includes reproducing, distributing, performing, and displaying the Recordings publicly or otherwise, creating derivative works, adapting, modifying, analyzing, and exploiting the Recordings. Best of Bangladesh may also use the Recordings for promotional purposes, such as testimonials.
  • Best of Bangladesh exclusively owns all rights, titles, and interests, including intellectual property rights, in and to the Recordings, all modifications, derivatives, and proceeds derived therefrom. Best of Bangladesh is under no obligation to share such profits with you.
  • You hereby permanently waive the right to inspect or approve the use or exploitation of any Recording, or any reproductions thereof, including your Images, and acknowledge that Best of Bangladesh has no obligation to use any Recording or otherwise exercise any rights with respect to your Images.
  • Your Images may be visible in Recordings that are accessible to the public, and third parties may keep, utilize or distribute these Recordings. After the Recordings are released to the public, Best of Bangladesh has no power over, and is not accountable for, any use or abuse (including distribution) by any third party of such Recordings.
  • By agreeing to allow the use or exploitation of Recordings (including your Images), you are irrevocably relinquishing all claims related to intellectual property, rights of publicity, rights of privacy, and any other damages or claims related to such use or exploitation. You confirm that you are of legal age and have read and fully comprehend the foregoing release.

5. Forward Looking Statements

‍Best of Bangladesh may make forward-looking statements regarding its future events or financial performance, as well as those of its affiliates or partners. While such statements are not historical facts, they reflect Best of Bangladesh’s current expectations. However, the actual results or events may differ materially, and such statements are subject to various uncertainties.

6. Assumption of Risk

Your attendance or participation in the event or any associated activities is fully voluntary and discretionary. Best of Bangladesh shall not guarantee access or admission to any or all portions of the event (including any session, breakout, keynote, or other activity). Unless expressly indicated by Best of Bangladesh, all event sessions, breakouts, keynotes, or other activities, if applicable, shall be subject to seating arrangements on a “first-come, first-served” basis.

To the utmost extent allowable by applicable law, you acknowledge and accept all risks, including but not limited to the hazards of personal injury or damage to personal property, which may arise during your attendance at the event, and you hereby relinquish any and all claims you may have against Best of Bangladesh, its affiliates, event sponsors, or event vendors, in connection with such risks. Best of Bangladesh reserves the prerogative, without prior notification, to restrict the number of event participants and attendees, to cancel or revoke any event registration, to prohibit any person from attending any portion of the event, and to decline providing any individual with access to event materials.

7. Changes to Best of Bangladesh Events

Best of Bangladesh’s events, encompassing the events’ substance and the presence of any speakers, exhibitors, or attendees, are susceptible to modification without prior notification. Best of Bangladesh does not assure the attendance of any individual, nor does it guarantee the execution of any of its scheduled events such as sessions, keynotes, or breakouts. Best of Bangladesh reserves the right to modify the event program (including but not limited to alterations in the schedule, content, features, or third-party attendance) at any time, for any reason, and without prior warning. In the event of any alteration or adjustment to the event, including but not limited to the schedule, content, features, or third-party attendance, no compensation will be issued.

8. Privacy

Best of Bangladesh has a steadfast commitment to protecting data privacy and safeguarding your personal information. All personal information gathered from you will be handled in accordance with Best of Bangladesh’s Privacy Policy. Best of Bangladesh utilizes your personal information obtained during your event registration to manage and facilitate your participation in the event. This includes event logistics, content, payment, updates, and communication purposes. Best of Bangladesh may reveal your personal information to third-party service providers enlisted by Best of Bangladesh to support in executing the event, and the handling of such information is subject to the privacy policies and practices of those parties. Apart from the aforementioned, Best of Bangladesh will not disclose your personal information to any third party without your consent except when obligated by law.

9. Indemnification

You hereby agree to defend, indemnify and hold harmless Best of Bangladesh, along with its employees, officers, board members, contractors, agents and affiliates, successors and assigns from any and all claims, demands, damages, losses, liabilities, and expenses (including, but not limited to, reasonable attorneys’ fees) incurred by Best of Bangladesh, resulting from (i) any negligent or intentional acts or omissions committed by you in connection with this Agreement, and (ii) any bodily harm, injury, death, or destruction of tangible personal property, including the event space and personnel, that occur during your attendance of the event.
